Rock Thoughts™ is an educational resource and as such, we strive to educate children and their parents, guardians, teachers, educators, and everyone with a vested interest in children’s education (collectively referred to herein as “Parents”) about how to appropriately safeguard children’s rights when using the internet. Rock Thoughts takes children’s privacy, integrity and safety very seriously and we are committed to complying fully with the Children’s Online Privacy Protection Act of 1998. The purpose of this policy is to inform you of how we collect, use, disclose, manage and store the personal information you may provide to us. Rock Thoughts reserves the right, at its own discretion, to update, modify or change any of these terms at any time. Such modifications shall be effective immediately upon being posted to our website.
2. The Information We Collect
As you explore our website, you will come across certain features that require identifying information from users. In most of these instances we are seeking non-personal information (e.g. a storyteller’s name, age or grade level, city or state where the rock’s are located) and in some cases, an e-mail address or name. All of these activities are purely voluntary and if you do not wish to reveal any such information, you are free to withhold it. If you decide to provide this information, we will not use it for any purpose other than as stated, and will not sell or rent your name or contact information to third parties not affiliated with Rock Thoughts other than as expressly set forth herein.
Our policy is not to collect any more information than is absolutely necessary in order for users to participate in the features we offer, to receive information from and about Rock Thoughts and/or to make purchases. We do not publicly post e-mail addresses or contact information and we do not distribute to third parties any personally identifiable information collected on our website, except in the limited instances as set forth herein.
Children Under Thirteen
We do not knowingly collect personally-identifiable information (referred to herein as “personal information”) from children under 13. Personally-identifiable information is all information that identifies a particular individual, such as his or her full name, postal address or contact information. All information pertaining to children under the age of 13 should be submitted to Rock Thoughts by a Parent. If we become aware that we have inadvertently received personal information from a child under the age of 13, we will delete such information from our records. Children under 13 should not send us any personal information about themselves, including their name, postal address or contact information.
Information Provided By Parents
Our goal at Rock Thoughts is to ensure that children have a safe and positive online experience. We encourage Parents to get involved with their children’s online usage and to be aware of the activities in which their children are participating. We suggest that Parents discourage children from providing any personal information on our website or elsewhere unless you are confident that the information will not be misused.
Any Parent who wishes to submit content to our website on behalf of a child under the age of 13 is free to do so. Parents should be aware that, because the storyteller name is publicly accessible to all users of our website, that information could be collected, used, and disclosed by others. Rock Thoughts is not responsible for the collection, use, or disclosure of such information. We therefore recommend that all storyteller names do not include any personal information. Rock Thoughts does not sell this information to any third parties, except in the limited instances as set forth herein.
We collect information for the following reasons:
(a) Posting Content
Children are allowed to submit stories, comments, questions, feedback or other creative content on our website (“Creative Content”). However, all Creative Content for children under 13 years old must be submitted by a Parent and the Parent will have the right to request that any Creative Content submitted by them on behalf of a child under the age of 13 be deleted from our website at anytime. We require that Parents do not include any personal information on the Creative Content before submitting it to the website. Rock Thoughts is not responsible for any damages resulting directly or indirectly from Creative Content that includes personal information.
Mindful of the importance of protecting children’s online experience, Rock Thoughts has implemented certain measures designed to monitor the content and information that is posted on our website. Such measures include approval by Rock Thoughts of Creative Content that is posted to our website before such content becomes publicly available. For this reason, Creative Content that is uploaded may not be immediately viewable. Notwithstanding the foregoing, while we make every effort to monitor the information on our website, we specifically disclaim any responsibility, liability, ownership or otherwise, for any content or other information that is posted on our website by any Member, user or third party. We ask that you please notify us immediately of any Creative Content or other publicly-available information that is of concern.
(b) Purchases and Distribution
If you choose to purchase an item through our website, we will need to collect additional information for billing and shipping, such as your full name, postal address, contact information and credit card information. We may be required to share this information with an independent third party service whose function is to verify the information you provide and to process the sale and distribution of your purchase.
(c) Electronic correspondence and Newsletter
In some instances on our website, we ask for your feedback, comments or suggestions and we provide you with a link for e-mailing us your response. If you send us an e-mail, it will include your e-mail address in the “From” line. We agree to use the e-mail address we receive in this manner only for the purpose of responding to your questions, feedback, comments or suggestions and will not provide your e-mail address to anyone else.
Rock Thoughts may provide Parents and participants with the opportunity to receive a newsletter or bulletin by e-mail. Parents and participants will be asked to confirm their interest in being added to our newsletter database. Parents and participants will always have the option to have personal information removed from our database by following the “unsubscribe” instructions found on the newsletter. All information collected for the Rock Thoughts newsletter is used only to send the newsletter and may be transferred, disclosed, or shared with third parties who may be engaged by us specifically to handle the preparation and delivery of the newsletter and perform other related technical and processing functions.
(d) Complaints and Customer Service
Rock Thoughts may collect personal information to properly investigate and respond to any complaints, questions or concerns that arise about our products and/or services. In addition, we may collect personal information to allow us to better serve you through enhanced products and customer service.
3. Disclosure of Personal Information
Except as set forth herein, Rock Thoughts does not disclose personal information provided by users.
Rock Thoughts reserves the right to collect, use and disclose your personal information without consent where required or permitted by law or as pertinent to judicial or government investigations or proceedings, or otherwise necessary to protect our website or the safety of its users. Rock Thoughts may use personal information in order to contact Parents in connection with certain features and projects offered through our website. In the event of a significant transaction or event involving Rock Thoughts, such as the sale of all or substantially all of Rock Thoughts interests and/or assets, merger, financing, liquidation or other similar transaction, Rock Thoughts may disclose personal information and any additional information collected from Parents and participants to the acquiring entity.
From time to time, Rock Thoughts may engage outside organizations to perform specialized services, such as, but not limited to, payment or purchase processing, prize fulfillment, collection of overdue accounts, etc. These service providers are only given the information needed to enable them to perform those services.
Without limiting the foregoing, personal information will only be disclosed with your consent which can be implied consent or express consent, depending upon the circumstances and the sensitivity of the type of information collected. We will rely on implied consent when we can reasonably conclude that you have given your consent by your action (e.g. by giving us your name and contact information so that we may send you products you have purchased) or inaction (e.g. by not exercising the ability to opt-out that is provided to you at the time your personal information is collected).
4. Reviewing/Removing Personal Information
If you have previously provided us with personal information and later decide that you do not want us to have it, please send a message to hello [at] rockthoughts [dot] com. Please include the words “Unsubscribe” in the subject line of your e-mail. We will try to accommodate your request as soon as possible.
5. Cookies and Log Data
“Cookies” are information files that your web browser places on the hard drive of your computer when you visit a website. Cookies cannot damage user files, nor can they read information from a user’s hard drive. Cookies are used to record whether a visitor has indicated that they have certain plug-in software applications installed on their browser. 6. Links to Other Websites
Our website may contain links to other websites that are not under our control, even though they may use the Rock Thoughts name or logo on their website through an agreement with us. This practice is standard on the internet and we do not control cookies placed on your computer by third parties whose advertising or links may appear on our website. We encourage Parents and participants to review the collection and privacy policies of those websites prior to providing any personal information.
Users should be aware that any personal information that is posted on Rock Thoughts is publicly available to other users of the website and could be collected, used, and disclosed by others. Rock Thoughts is not responsible for the collection, use, or disclosure of such information posted on our website. We strongly discourage Parents and participants from providing personally identifiable information, including full names and contact information, in any information or content that they upload on the website.
7. Security of Private Information
To prevent unauthorized access, maintain data accuracy and ensure the correct use of information, we have put in place appropriate physical, electronic and managerial procedures to safeguard the information we collect online. Please note, however, that no data transmission over the internet, or by other means, can be guaranteed to be 100% secure. Thus, while we strive to protect your personal data, Rock Thoughts cannot ensure or warrant the security of any information you transmit to us. Therefore, you understand, acknowledge and agree that you transmit certain personal information over the Rock Thoughts website at your own risk.
In addition, in certain instances, we will be required to disclose private information to necessary parties to protect our website or other visitors, in compliance with court orders, subpoenas or as necessary to satisfy any legal regulations, in cooperation with (a) law enforcement or government requests or where were believe it necessary to investigate suspected illegal activities, fraud or violations, (b) affiliated entities for business, operation and marketing purposes, or (c) third party in connection with a corporate sale, merger or restructuring.
Notwithstanding anything set forth herein, you are responsible for maintaining the confidentiality of your information and for restricting access to your computer.
8. California Privacy Rights
Beginning on January 1, 2005, California Civil Code Section 1798.83 permits participants of Rock Thoughts who are California residents to request certain information regarding its disclosure of personal information to third parties for their direct marketing purposes. To make such a request, please send an e-mail to hello [at] rockthoughts [dot] com and include the words “California Privacy Rights” in the subject heading. We will try to accommodate your request as soon as possible.
